LovingIs… AI is a family-safe, emotionally supportive platform designed to promote well-being and learning.
 
We comply with:

 • COPPA (Children’s Online Privacy Protection Act — United States)

 • LGPD (General Data Protection Law — Brazil)

 • Other applicable global child safety and privacy regulations
 
We support the following user groups:
 
Children Under 13
 
Children under age 13 may only use the Service with prior verifiable parental consent.
 
Acceptable forms of verifiable consent include:

 • Credit or debit card verification

 • Government-issued ID with secure deletion post-verification

 • Live video confirmation with authorized support staff

 • Any other FTC-approved verification method
 
Parents or legal guardians are fully responsible for:

 • Creating and managing the child’s account

 • Reviewing and controlling data permissions

 • Monitoring the child’s interactions and use

 • All consequences of their child’s use of the Service
 
Users Ages 13–17
 
United States: Parent or guardian permission and oversight is required.

 Brazil and jurisdictions with similar laws: Verifiable parental consent is required.
 
Adults 18+
 
Full access to the Service is permitted in accordance with these Terms.

2. Account Responsibility and Security
Users agree to:

 • Provide accurate registration information

 • Maintain the confidentiality of account credentials

 • Notify us immediately of unauthorized account use
 
We reserve the right to suspend or terminate any account for safety, compliance, or misuse concerns.
3. Inputs, Outputs, and Intellectual Property
“Input” refers to content a user submits to the Service.

 “Output” refers to content generated by the Service in response.
 
Users retain all rights to their Input.
 
Subject to compliance with these Terms, users are granted rights in the Output provided to them; however:

 • Output may not be unique

 • Similar Output may be provided to other users

 • Output may be inaccurate, incomplete, or fictional

 • Output may not be used as a substitute for professional advice including legal, medical, financial, psychological, or safety-critical decision-making
 
All rights not expressly granted remain with LovingIs… AI and its licensors.
4. Acceptable Use Policy
Users may not:

 • Harm, exploit, or endanger minors

 • Generate or share abusive, hateful, violent, or illegal content

 • Engage in identity impersonation or privacy violations

 • Upload or transmit sensitive personal data (such as Social Security numbers, banking credentials, health records)

 • Attempt to reverse-engineer, abuse, or disrupt the Service

 • Use the Service for spam, surveillance, or unauthorized data collection

 • Use the Service for activities that violate any applicable law
 
We may report unlawful, dangerous, or exploitative behaviors to relevant authorities.
 
LovingIs… AI is committed to protecting user safety and will take action where necessary.
5. Data Use and Privacy
We may use Input and Output to:

 • Provide, maintain, and improve the Service

 • Personalize experiences

 • Support emotional and safety monitoring

 • Train or evaluate our AI models, only where we have the lawful right to do so
 
Where functionality exists, users may request to opt-out of model training.
 
We do not:

 • Sell personal data

 • Use minors’ information for behavioral advertising

 • Create persistent profiles of children without verifiable parental consent
 
Our Privacy Policy provides additional required disclosures regarding:

 • Parental data rights and deletion processes

 • Third-party data processors

 • Data retention timelines

 • Safety monitoring technologies

 • International data transfer protections
6. LovingIs… AI Intellectual Property
LovingIs… AI owns all rights in and to the Service including but not limited to:

 • Software and infrastructure

 • AI models and related technologies

 • Branding, trademarks, design, and content
 
Users may not copy, distribute, or create derivative works without explicit authorization.
7. Feedback and Contributions
If a user provides feedback, ideas, or suggestions, LovingIs… AI may use that contribution freely and without obligation of compensation or attribution.
8. Emotional Well-Being and Safety Disclaimers
The Service promotes kindness, learning, and self-reflection; however, it does not provide:

 • Licensed mental health treatment

 • Medical advice or diagnosis

 • Emergency or crisis response

9. Warranty Disclaimer and Limitations of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTY OF ANY KIND.
 
We are not liable for:

 • Decisions or actions taken based on Output

 • Loss of revenue, data, opportunity, or goodwill

 • Service interruptions, technical failures, or unauthorized access
 
Where liability cannot be excluded, it is limited to:

 The amount paid by the user during the three months prior to the claim, or one hundred dollars (USD $100), whichever is greater.
 
Certain jurisdictions may provide additional consumer protections; those protections will apply as required by law.
10. Termination and Enforcement
We reserve the right to:

 • Suspend or terminate access to the Service

 • Remove content that violates these Terms

 • Restrict access when safety or well-being risks are identified

 • Report violations to law enforcement where required or appropriate
 
Users or parents may request account deletion at any time.
11. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles.
 
Disputes will be resolved through binding arbitration in Chicago, Illinois, except where consumer protection laws prohibit arbitration or provide alternative rights.
 
Class action waivers may apply where lawful.
12. Changes to These Terms
We may update these Terms from time to time. Material updates will be communicated in advance. Continued use of the Service constitutes acceptance of any updated Terms.
